By accessing, purchasing from, or using any products and services provided by Carolina Fitness Equipment, you (“customer,” “you,” or “your”) agree to the following Terms and Conditions. Please read them carefully.

1. General Use

• These Terms govern all sales, rentals, services, and use of our website and facilities.
• We reserve the right to update or modify these Terms at any time without prior notice.
• Continued use of our services or equipment constitutes acceptance of any updated Terms.

2. Sales & Purchases

• All sales are final unless otherwise specified in writing.
• New equipment is subject to manufacturer warranties, if applicable. Used equipment is sold “as-is” unless otherwise stated.
• Payment in full is required at the time of purchase unless prior arrangements are made.
• Prices are subject to change without notice.

3. Rentals & Deliveries

• Rental agreements must be signed before equipment is delivered.
• Customers are responsible for the care, safe use, and return of rented equipment in the same condition as received (normal wear excluded).
• Delivery and pickup fees may apply. Missed delivery or pickup appointments may incur additional charges.
• Any damage, loss, or misuse of rental equipment may result in repair or replacement charges.

4. Services & Installation

• Service and installation appointments must be scheduled in advance.
• Customers are responsible for providing accurate information regarding delivery and installation sites.
• We are not responsible for delays caused by factors outside our control, including site conditions, weather, or customer scheduling.

5. Returns & Refunds

• Returns may only be accepted with prior authorization.
• A restocking fee may apply to returns of non-defective items.
• Shipping and handling charges are non-refundable.
• Custom orders, clearance items, and used equipment are non-returnable unless defective upon receipt.

6. Liability & Safety

• Customers assume full responsibility for the use of equipment purchased or rented.
• Carolina Fitness Equipment is not liable for injuries, accidents, or damages resulting from misuse, improper installation, or failure to follow safety guidelines.
• Always consult a medical professional before beginning any exercise program.

7. Warranties

• Manufacturer warranties, if available, will be honored according to the manufacturer’s terms.
• Carolina Fitness Equipment does not provide additional warranties unless expressly stated in writing.

8. Payment Terms

• Accepted forms of payment include credit card, debit card, ACH, and approved financing.
• Late payments may be subject to additional fees.
• Failure to pay may result in collections or legal action.

9. Privacy & Data

• Customer information is used solely for order fulfillment, communication, and service improvement.
• We do not sell customer data to third parties.

10. Governing Law

• These Terms shall be governed by and interpreted under the laws of the State of North Carolina.
• Any disputes shall be handled in the courts of Mecklenburg County, NC, unless otherwise agreed in writing.
